OTE Copyright & Intellectual Property Rights Protection Policy
Note: Onlinetradeexpo.com and Online Trade Expo both are considered as one and the same legal person and are mentioned as OTE all through this document.
Online Trade Expo (OTE) respects the intellectual property rights of others and expect our members and users to do the same. Unauthorized use of another party's materials and trademarks are dealt with all seriousness. It is not only a matter of law, but also one of professionalism and trust.
Counterfeits, non-licensed replicas, unauthorized use of brand names, logos, graphics, art, characters and any trademark, copyright or license protected property is strictly forbidden on OTE
Members displaying products on OTE must either own the rights to or have official license to the rights to use any branded products and all images, media, logos and names displayed on their profile and on the site. OTE may require members to furnish a certificate showing licensing of certain branded products in able to display them on the site.
Upon discovery of any transactions or offers to sell or buy unauthorized products on or through the OTE site will be cause for immediate action.
Repeat Intellectual Rights Violations may result in a range of actions, including:
- Removal of listing(s)
- Account, listing and posting limitations
- Account suspension
- Account Termination
OTE enlists the following actions to prevent Intellectual Rights Violations:
- Regular OTE staff review and removal of listings that appear to offer counterfeit, non-licensed replicas or unauthorized items.
- OTE will promptly suspend the listings of a member when an intellectual property infringement claim is filed against them by the rights holder.
- Written notification of actions taken is sent to Members who have their listings suspended by OTE for suspicion of Rights Infringement.
- In the event of an Infringement claim, both parties will have equal opportunities to respond to a dispute.
When appropriate, members who are repeat offenders will have their account terminated.
OTE expects each and every member to behave responsibly and professionally towards each other with respect to building a profitable and valuable business environment.
- Anyone submitting a claim of infringement is expected to stand behind their claim. By submitting a report of alleged infringement to OTE, you agree to indemnify OTE against claims or damages arising from the removal of the listing.
- OTE is not arbiter or judge of intellectual rights disputes. By suspending a profile, as a prudential action, OTE is not endorsing a claim of infringement. Instances in which OTE declines to suspend a listing, OTE is neither determining whether the listing is infringing or not, nor is OTE endorsing the sale of products in such cases.
- OTE regards frivolous complaints and claims as serious infringement on the rights of members to do business without harassment on the site. Such unprofessional behavior if discovered will result in a review, suspension and possible termination of an offenders profile and contract of service.
To Report an Intellectual Rights Claim:
- If in good faith you believe that a listing by an OTE member infringes your copyright, trademark, patent or other intellectual property Please submit a detailed report including the member profile, the offending listings (include individual URLs), a description of the violation and your complete contact information to claims@onlinetradeexpo.com Claims may also be filed by fax to 01 - 646 - 895 – 9539
- Once OTE receives a claim we promptly evaluate the submission and when appropriate we will expeditiously suspend the listings.
- OTE then will notify the member of the suspension of the infringing product listings and provide the member with your contact information so they may contact you directly to respond.
- Should a member object to a claim and suspension of alleged infringing listings the member may submit a counter-claim. OTE will review any counter-claim and may remove the suspension pending any notice from you of any action filed against that member by a court with jurisdiction over the claim.
OTE will do everything we can to create a safe, secure and fair environment in which to transact the business of buying and selling to the trade. Every member has invested valuable time and money in building their business and OTE, out of respect for that will rather err on the side of caution in doing what we can to protect your business on this site.
